Delta-9 THC is the most common form of THC extracted from marijuana plants. Hemp-derived Delta-9 THC (or Hemp D9) is a type of THC that is extracted from hemp plants.
Hemp plants are a type of cannabis plant that contains less than 0.3% THC.
Delta 9 THC and hemp-derived Delta-9 THC are the same molecule and deliver the same “high”.
Hemp D9 can be derived from hemp naturally, but more often than not it is synthesized using chemical processes. This does raise the question about whether synthetically-derived THC is safe as it has only been around for a few years.
Hemp-derived delta-9 THC is legal in the United States under the 2018 Farm Bill, and although the law states it’s limited to being 0.3% delta-9 by dry weight, that’s it (we’ve heard this means you could get as much as 1000mg of THC in a single drink if you wanted to).
With Minnesota legalizing low doses of hemp-derived delta 9 THC, this has opened the floodgates around the legal ambiguities created by the U.S. Farm Bill, as we’re now seeing the proliferation of Hemp D9 THC-infused products across the US.
Here are some of the reasons why there is so much excitement about Hemp D9 drinks:
- It is legal in most States (some D9 brands are shipping to all 50!).
- You get the same “high” as marijuana THC
- Is a great option for people who do not like the taste of marijuana.
- It can be purchased online and delivered to your door.
- Brands can sell outside of dispensaries: hotels, bars, liquor stores, convenience stores, stadiums, salons… you name it.

It is important to please check the laws in your State before purchasing hemp-derived delta-9 THC drinks.
Hemp D9 regulation
Some of the regulatory areas in play:
Licensing and Distribution: Some states treat THC drinks like other cannabis products, requiring them to be sold only through licensed dispensaries. Others, like Minnesota, have created a “quasi-legal” market where these products can be sold in general retail settings, like liquor stores or convenience stores. Some states are even creating special “infused beverage endorsements” for retailers.
Potency Limits: Many states that have regulated THC drinks have established limits on the amount of THC per serving and per container. Common limits are around 5mg of THC per serving and 10mg per container. However, some states, like Missouri and Wyoming, have bills that would allow for much higher limits.
Labeling and Packaging: States often have strict requirements for the labeling and packaging of THC drinks. These may include:
- Mandatory use of the THC symbol on the packaging.
- Resealable and child-resistant packaging.
- Clear and accurate information about potency, ingredients, and disclaimers.
- Prohibitions on packaging that may be appealing to minors or that resembles commercially available food products.
Age Restrictions: In all states where THC drinks are legal, they are restricted to adults aged 21 and older. Retailers are required to check for a valid ID at the point of sale
We’ll likely see some updates to the Farm Bill in 2026.
